The famous newspaper is suing OpenAI and Microsoft over the use of journalistic content to train the ChatGPT and Microsoft Bing Chat (now Copilot) engines.

In negotiations that lasted for months and later ceased, OpenAI insisted that the use of the Times' content fell under 'fair-use', as it served to generate transformative content. In response, the newspaper claims that there is nothing transformative about the conduct, since the acquired content is used to create material to replace journalistic material in order to deflect the public towards its own services.

The complaint also mentions that 'doing good journalism today is more difficult than ever, with business models that previously supported quality content now completely collapsed'.
