The degree of Copyright protection an artist should expect after publishing his or her work on social media is always an unclear issue. Recently, it has been made even more confusing by the latest developments in technology within social networks.

An appeals court taken to task dug deeply into the functionality of HTML to confirm that embedded photos are not copies of the original photos, but links to where they are stored.

The case was originally opened in 2021, consequential to a complaint by photographers Alexis Hunley and Matthew Brauer. The two claimed that Instagram had ignored the protection offered by their Copyright, allowing media outlets to "embed" photos they themselves had posted on their accounts.
